Increasing numbers of couples in the UK are seeking to enter into a pre nuptial or post nuptial agreement. Our team has extensive experience in both negotiation and drafting documentation in this area. Our lawyers understand that this can be an anxious time for some people, and are on hand to offer sensitive and practical advice.
Prenuptial agreements are designed for people who intend to get married or enter in a civil partnership. The document sets out what should become of their finances should the relationship ever breakdown. Prenuptial agreements are also sometimes refereed to as an ante nuptial or a premarital agreement. Post nuptials carry out the same purpose, but take place after the couple has married or entered into a civil partnerships.
As a consequence of a landmark case in October 2010 (Radmacher v Granatino) couples in this country can, arguably for the first time, enter into a marriage or civil partnership more secure in the knowledge that a properly drafted Pre-Nuptial Agreement may prevent their having to attend Court in the unfortunate event that the relationship fails.
Our private client team understand that discussing what should happen in the event of a divorce is a sensitive matter. However, discussion of these matters at an earlier stage provides peace of mind for the future, and for increasing numbers of people, has become part of the marriage process.
Both pre nuptial and post nuptial agreements can hold great importance. Legal advice should always be sought regarding the implementation and consequences of such agreements.
