GP Survey in Clinical Commissioning Reforms


A Survey by DMH Stallard, Kurt Salmon and Pulse

Overview of Results

The changes proposed to clinical commissioning within the health sector are developing rapidly and there appear to be lots of questions to answer and issues to deal with as the reforms progress and Clinical Commissioning Groups (“CCGs”) take shape.

Solicitors DMH Stallard LLP and Management Consultants Kurt Salmon commissioned a survey in association with Pulse to look at some of the more practical legal, governance and management issues that are worrying GPs at grass roots level.

From the legal perspective, a number of the survey’s findings gave cause for concern.

Of those surveyed:

  • 89% were either concerned or unsure of their potential legal liabilities as a GP, practice and Clinical Commissioning Group (“CCG”) member as a result of the NHS reforms
  • 86% had not reviewed any of their existing contracts or other legal documents listed in the survey in preparation for the NHS reforms
  • 65% had not undertaken or were unaware of having undertaken any due diligence on other practices in their CCG, such as operational performance or organisational or governance structures
  • 75% had no plans to share property or other assets, back-office functions, clinical services or merge with another practice, despite the key shared services/costs savings agenda in the wider public sector
  • 85% were either unsure or not confident that they had the skills and training for the commissioning responsibilities to be expected of them

Clearly, GPs are going to need a lot of legal and other professional support and training if they are to help make the NHS reforms a success, as well as doing their day job looking after the health of families across the country.

  • The survey took place over three weeks in October 2011 and 400 GPs took part.
