Tribunal Advice / Representation

We have considerable experience of representing clients (mostly employers and senior executives) at hearings in Employment Tribunals throughout England and Wales.

Members of the Group are well respected advocates with an in-depth knowledge of the Employment Tribunals, and the special Rules of Procedure which apply. As specialists we do not practice in other areas of law; our focus means that we offer a very high level of expertise. Clearly, each case is unique in terms of the facts and personalities involved, and our strength and depth in this area means that we can provide a high level of support to clients and give them a clear understanding of how the Tribunal system operates.

The overwhelming majority of our clients use our advisory service which means that they often avoid ending up in the Tribunal. In some cases, however, a claim will move inexorably to the Employment Tribunal. Our expertise in this area of law, and of advising clients both before and during the Tribunal process means that we are often asked to represent a client who, for whatever reason, decides that their case will be better presented by experts in the field. The Tribunal Rules of Procedure have become more detailed and complex over the last couple of years, and we believe that our knowledge in this area means that we can ‘add value’ when representing clients.

Most of the claims that we deal with involve multiple jurisdictions, such as discrimination, whistle-blowing and unfair dismissal.

In addition to our own experienced advocates we are able to draw on expert Counsel in the field where the client’s needs are better served by engaging those services.

Our charging structure for Tribunal cases is flexible, and we will always identify with you both the costs and risks of this litigation process at an early stage.

Examples of recent cases in which we have represented clients in the Employment Tribunal include:

  • Sex discrimination arising from maternity leave

  • Failure to consult in respect of a TUPE transfer

  • Disability discrimination and the failure to make reasonable adjustments

In addition to our work in the Employment Tribunal we also handle cases before the Employment Appeal Tribunal in London.
