While we all want to make our own decisions for as long as possible, this is not always possible – whether due to old age, illness or injury.
In the unfortunate event that someone you know becomes unable to deal with their own affairs our specialist team can help you apply to the Court of Protection to be appointed as a deputy.
How our private client lawyers can help
We have solicitors in our Court of Protection team who either act as deputies and attorneys or we can help anyone already appointed by the court.
Our services include:
- Preparing powers of attorney
- Registering powers of attorney
- Advising attorneys
- Assisting elderly clients and those acting for them
- Making applications to the Court of Protection for the appointment of deputies
- Acting as or for deputies
- Managing the property and affairs of those lacking capacity
- Making applications to the Court of Protection for statutory wills, gifts and trusts
How our private client lawyers work
As with all our private client services, our Court of Protection work is carried out with skill and sensitivity, with a priority of excellent communication throughout.
How we've helped
DMH Stallard were approached by West Sussex Social Services in connection with two sisters who had sadly both lost their mental capacity and were unable to manage their affairs and continue to live independently. DMH Stallard were involved in finding a suitable Care Home for them that specialised in dementia care. As the sisters had no extended family or close friends, DMH Stallard Trust Corporation applied to the Court of Protection to be appointed as their Deputies.
Once appointed and suitable nursing home care was arranged for the sisters, DMH Stallard were able to market and sell their property. Following the sale, DMH Stallard consulted an independent and trusted IFA as to available investment opportunities to ensure a regular income to cover nursing home fees and meet the sisters’ general expenses. At all times DMH Stallard considered the sisters’ best interests, took reasonable care when making decisions on their behalf, and took necessary steps to protect their assets. Whilst acting, DMH Stallard has complied with the directions of the Court of Protection.
