The welfare of older and vulnerable people often involves an understanding of the complex legal issues relating to trusts, mental health and social care, and may require family and friends to take difficult decisions with little advance warning.

We work closely with families and carers to plan ahead and ensure that the pressures and additional stresses of looking after the individuals’ finances are removed.

If, however, events are sudden and unexpected and advance planning is not possible, we will work with the family and friends of the person concerned and the Court of Protection to make sure the necessary care and financial arrangements are put in place.

How we've helped

A long standing client of the firm contacted us as he was concerned that he was being pressurised to invest in a Bond and to place his property in Trust. Whilst visiting the client we heard first hand the aggressive sales approach of the investment company who were regularly telephoning the client insisting that he had entered into an irrevocable agreement whereby payments needed to be made. DMH Stallard were able to assist the client in making his own decisions, explaining to him his own financial situation to allow him to plan for his future, and support him to stop all contact from the investment company.

DMH Stallard prepared a Property and Financial Affairs Lasting Powers of Attorney where the client appointed the DMH Stallard Trust Corporation as his attorney, enabling us to assist and support him to make and execute decisions whilst he retained mental capacity. Further, the LPA  allowed the firm to protect our client’s best interests following the loss of mental capacity.
