How our private client lawyers work

 

When a person dies, those appointed by their will (executors) need to apply for a grant of probate and to administer their estate.

Where there is no will, the law sets out who is entitled to apply for a grant of letters of administration (administrators) and thus to administer their estate.

We can help clients deal with the complications which can arise in administration as they are required, for example, to liaise with the Probate Registry and the Inland Revenue before any assets are sold, accounts closed, bills paid and assets transferred.

How we've helped

DMH Stallard advised the executors of estate where the Deceased was a Lloyds name with assets held within a company registered at Lloyds. DMH Stallard successfully claimed Business Property Relief over various assets within the estate. They advised the executors on a Deed of Variation which was successful in securing a reduction in the Inheritance Tax payable, in accordance with the Deceased’s Letter of Wishes. Further on-going advice was provided to the executors on the creation of Trusts under the Will and also the purchase of accommodation for the lifetime beneficiary using the Trust.

DMH Stallard’s corporate team advised the executors and coordinated the sale of the company holding assets at Lloyds.
