A market leader in real estate litigation, especially commercial assets, with a specialist interest in non-domestic rating.

Roger has acted for financial institutions, family offices, sovereign wealth funds and the occupiers of commercial real estate assets including retailers, office occupiers and utility companies.

His expertise covers real estate disputes relating to the ownership and occupation of land, leasing, rent review and valuation. Roger has developed a specialist expertise in non-domestic rating acting for ratepayers in dispute with valuation officers or billing authorities.

Roger is in the Legal 500 Hall of Fame for property litigation and is described as “technically brilliant”. Chambers and Partners 2025 ranks Roger as a “senior statesperson” and reports that “Roger knows his clients well and has an excellent litigious mind. He is easy to engage with and is always timely in his responses.”

Work highlights

Acted for the British Property Federation and the Rating Surveyors Association in the UK Supreme Court case of Monk V Newbigin and for the ratepayer in the follow case of Canary Wharf v Jackson.


RATING LIST ASSESSEMNT VALIDITY CLAIM

Acted for a ratepayer in a dispute with the Valuation Officer as to the validity of a purported alteration made to a rating list assessment. The issue concerned whether the VO had acted in time. The Valuation Tribunal upheld Roger’s case that it had not.


ATM LITIGATION

Represented one of the retailers in the ATM litigation from before the Valuation Tribunal hearing to the UK Supreme Court hearing.
