If you are considering an arrangement like this, it’s important to get advice at an early stage. Pre-nuptial agreements must be formalised well in advance of any marriage for example, and there are other requirements too such as ensuring that each side receives independent legal advice that you need to be aware of.

Advising high net worth individual on cohabitation and pre-nuptial agreements
Our client had substantial capital assets and sought advice on what kind of financial claims could be made by a cohabitee on the one hand and a spouse on the other in the event of a relationship breakdown. He wanted to know if he should enter into a pre-nuptial agreement ahead of his marriage and needed specialist advice on the law surrounding nuptial agreements in England and Wales.
Because of the value of the assets, highly technical tax and trust law advice was required. This enabled us to suggest a number of different potential settlements and to give our client a thorough appraisal of the financial implications of each type of settlement. This meant the client could make informed choices as to proposals to put forward to his fiancée in negotiating the agreements.
Acting on our advice, the client agreed the terms of both a cohabitation agreement and pre-nuptial agreement, with DMH Stallard preparing both documents. The case was unusual given the value of the assets and need for careful and considered advice.
